Terms of Use & End User License Agreement

By accessing or using the SportSensAI website, mobile application, and related services (collectively, the "Service"), you agree to be bound by these Terms of Use and End User License Agreement (collectively, "Terms"). If you do not agree, you may not use the Service.

• The Service is licensed, not sold, to you.
• Payments, subscriptions, and fees are non-refundable except as required by law or applicable app store policies.
• Disputes are subject to binding arbitration and class-action waiver (Section 11).
• Your personal data is handled per our Privacy Policy.

SportSensAI grants you a limited, non-transferable, revocable license to install and use the mobile app and website solely for your personal, non-commercial fitness purposes. Standard carrier data charges may apply. Your use of the mobile app is also subject to the terms and conditions of the applicable app store (Apple App Store or Google Play Store).

You must create an account to access most features. You are responsible for maintaining the confidentiality of your credentials and for all activities that occur under your account. You may delete your account at any time as described in Section 14.

All content, trademarks, and technology on the Service are owned by SportSensAI or its licensors. Except for the license granted in Section 2, nothing herein transfers any intellectual property rights to you.

You retain ownership of content you upload (e.g., workout data, comments). By posting, you grant SportSensAI a worldwide, royalty-free license to use, display, and adapt your content for operating and improving the Service. You agree not to post unlawful, defamatory, or obscene material.

• No reverse-engineering, scraping, or unauthorized access.
• No infringement of third-party rights.
• No use of the Service for medical advice, diagnostics, or treatment.
• You will not engage in any activity that interferes with or disrupts the Service.
• You will comply with all applicable laws and regulations when using the Service.

The Service may contain links to third-party websites or integrate third-party services and SDKs for functionality such as payment processing, analytics, and crash reporting. SportSensAI is not responsible for third-party content or practices. Your interactions with third-party services are governed by their respective terms and privacy policies. Details about our third-party integrations are provided in our Privacy Policy.

The Service is provided "as is" without warranties of any kind. To the maximum extent permitted by law, SportSensAI shall not be liable for indirect, incidental, or consequential damages arising from your use of the Service. Our total liability to you for any claims shall not exceed the amount you paid for the Service in the 12 months preceding the claim.

We may update the Service and these Terms from time to time. Material changes to these Terms will be communicated through the app or via email. Your continued use after notification constitutes acceptance of updated Terms. We may provide automatic app updates to fix security vulnerabilities or critical issues.

Any dispute arising out of these Terms will be resolved by binding arbitration in Florida, except that either party may seek injunctive relief in court for intellectual-property matters. You waive the right to jury trial and to participate in class actions.

These Terms are governed by the laws of the State of Florida, United States, without regard to conflict-of-law provisions.

These Terms remain in effect until terminated by you or SportSensAI. You may terminate at any time by deleting your account and the app as described in Section 3. We may terminate or suspend access at our discretion with or without notice for violations of these Terms.

Individual users can permanently delete their account in the mobile app settings, which triggers immediate erasure of personal data. Organisation users must request deletion through their team administrator or via our web form at sportsensai.com/account-delete; these requests are completed within seven (7) days.

• Encrypted disaster-recovery backups are retained for up to 30 days before automatic purge.
• Subscription payment and tax records are retained for up to seven (7) years as required by law and then anonymised or deleted.

Section headings are for convenience only. If any provision is found unenforceable, the remaining provisions remain in full force. SportSensAI may assign these Terms; you may not without our prior written consent. These Terms constitute the entire agreement between you and SportSensAI regarding the Service.

This section applies only if you use the SportSensAI mobile application on an iOS device. You acknowledge that these Terms are between you and SportSensAI, not Apple Inc. ("Apple"). Apple is not responsible for the App or its content and has no obligation to provide maintenance or support.

In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any). To the maximum extent permitted by law, Apple has no other warranty obligation with respect to the App.

Apple bears no responsibility for: (a) product liability claims; (b) claims that the App fails to conform to legal or regulatory requirements; or (c) claims under consumer protection or similar legislation. Apple bears no responsibility for intellectual-property claims related to the App.

You agree to comply with applicable third-party terms when using the App. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you. You represent and warrant that (i) you are not located in a country subject to U.S. Government embargo or designated as a "terrorist supporting" country and (ii) you are not on any U.S. Government list of prohibited or restricted parties.

This section applies only if you use the SportSensAI mobile application on an Android device downloaded from Google Play Store. Your use of the app is also subject to the Google Play Terms of Service. In the event of any conflict between these Terms and the Google Play Terms of Service, the Google Play Terms of Service will govern with respect to your use of the app.

For subscription services purchased through Google Play, billing and subscription management are handled by Google according to the Google Play Terms of Service. You may cancel subscriptions through your Google Play account as described in Section 8.

Google is not responsible for the app or its content beyond its role as the distribution platform. Any issues with the app should be directed to SportSensAI, not Google.
